Protecting the confidentiality and security of personal data is integral in the way that which Amphora conducts business.

Amphora is a CTRM / ETRM software company and comprises of the following subsidiaries: Amphora Switzerland GmbH, Amphora UK Ltd., Amphora Software Pvt. Ltd. and Amphora Software Pte. Ltd. (the “Amphora Group”).  This Privacy Policy is issued on behalf of the Amphora Group so when we mention “Amphora”, “we”, “us” or “our” in this Privacy Policy, we are referring to the relevant company in the Amphora Group responsible for processing personal data. Amphora is responsible for this website. This Privacy Policy only applies to the processing activities undertaken by the Amphora Group.

This Privacy Policy does not apply to information collected, stored, shared, or distributed by third-party sites. This Privacy Policy does not apply to Amphora’s employees, who are covered by our internal policies, procedures and notices.

WHAT INFORMATION WE COLLECT

We process personal data that originates from three sources: data you give, data we get from different sources, and data gathered consequently.

The first category of personal data, where you give information to us, includes data that you have given through our third-party products or through our client support portal (“JIRA”) or our website, through day to day interaction by phone or email support, and as a visitor or guest to one of our offices. We receive personal data from different sources, including public sources, information from our employees, and information from our clients. We also collect personal data automatically, including when you visit our website or use our IT systems and networks.

When you log in to use JIRA, you provide Amphora with your username and email address. Your login credentials may have been created upon request by you or assigned by Amphora or your own company with whom we may have a direct contractual relationship with.

As a client of Amphora, you might give us personal data during interactions as necessary to support our business relationship. This information normally consists of business contact details and, in relation to vendors or individuals and third parties that are used to assist in product development, troubleshooting, and client support in some cases.

Amphora does collect personal data from the public domain that is available about individuals or companies with whom we seek to build a business relationship with, for purposes of generating leads. Where permitted, we utilize third party services that perform these online searches for us such as Sales Force. This information normally consists of business contact details.

INFORMATION WE COLLECT AUTOMATICALLY

Cookies.  Cookies are pieces of information that a website transfers to a user’s computer for purposes of storing information about a user’s preferences.  Cookies in and of themselves do not personally identify users, although they do identify a user’s computer.  Many websites use cookies as a standard practice to provide useful features when a user visits the website and most web browsers are set up to accept cookies. Guests and utilization of Guest Wi-Fi. If you visit one of our offices and utilize our guest Wi-Fi, we automatically collect information about your mobile device, including but not limited to: your IP address and MAC address of said devices and store your online activities. Use of our Wi-Fi is subject to Amphora’s Acceptable Use Policy, which you must accept to connect to our guest Wi-Fi connection.

Web Beacons. Some of the website’s web pages may use web beacons in conjunction with cookies to compile aggregate statistics about website usage. A web beacon is an electronic image (also referred to as an “action tag,” “single-pixel,” or “clear GIF”) that is commonly used to track the traffic patterns of users from one web page to another in order to maximize web traffic flow and to otherwise analyze the effectiveness of the website.  Some web beacons may be unusable if you elect to reject their associated cookies.

Response to “Do Not Track” Signals. Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates, although web browsers incorporate and activate this functionality in different ways, and it is not always clear whether users intend for these signals to be transmitted. There currently is disagreement, including among participants in the leading Internet standards-setting organization, concerning what, if anything, websites should do when they receive such signals. Amphora currently does not take action in response to these signals, but, if and when a standard is established and accepted, we may reassess how to respond to these signals.

We do not use any of your data for automated decision making (including profiling).

How we utilize the personal data we collect about you depends on the purpose for which it was provided to us. We will use your personal data only (i) to operate the website; (ii) to provide Amphora products and related services to you; (iii) to address your requests for information (iv) to contact you about events we think might interest you; (v) to maintain or administer the services, perform business analyzes, or for other internal purposes to improve the quality the business and the products and services Amphora offers; or (vi) as otherwise described to you at the point of collection or pursuant to your consent.

We may share your personal data with third parties in connection with the potential or actual sale of Amphora and or assets, and those of any subsidiaries of the Amphora Group, through mergers or any acquisitions, changes in control of divestitures, or in connection with bankruptcy or insolvency, in which case personal data that is held by us about our users might be one of the transferrable assets. Where appropriate, we will take measures to require the recipient of your personal data to be treated in accordance with this Privacy Policy.

DATA TRANSFER OUTSIDE OF THE EEA

This website is hosted in the United States. If you are visiting the website from outside the United States, your personal data may be transferred to, stored and processed in the United States in accordance with this Privacy Policy and applicable US laws. RETENTION OF YOUR PERSONAL DATA

Amphora aims to retain your personal data for as long as necessary to fulfil the purposes for which it was collected. Thereafter, we will delete (or otherwise erase, de-identify or pseudonymize or equivalent) any such personal data except as required or permitted by applicable law or regulation.

CHILDREN

The Amphora website is not for use by children under the age of 16 years of age. Amphora does not knowingly collect, store, share or utilize this personal data of children under the age of 16 except for in certain circumstances in performing its obligations in respect of its employees.
